Employee gets into argument

    Randy you and I work in an "at will" state. You can fire anyone at anytime with the exceptions of race, gender, religion etc. A guy talks back to you, is one minute late, fudges a time card, whatever.......you can fire him with no repercussions..........do it!

    I think you handled it very properly and professionally. It is all to easy to take a knee-jerk reaction without having the entire story and then regreting the action later. By immediately suspending both employees you gave yourself time to step back and act rationally without endangering other employees or appearing to lack control. Your final actions were based on facts, not emotion, and considered all sides of the issue. By acting rationally, rather than emotionally, you have put your club in the best possible position should the employees mother decide to pursue legal action. At the same time, other employees will appreciate the fairness you have shown in gathering all the facts before final action.

    Thanks Steve, I think I did what was best in the situation. the employee was not happy to get fired and was actually surprised. I told him point blank it takes two people to get into an argument and with the two people involved one did not even need to argue since he had to power to terminate you on the spot for arguing. that it got to where it did cost two good workers the job. And I gave him his pink slip. My ex-assistant on the other hand came in cleaned out his locker ask me if there was any way to keep his job and I told him if they would of gotten into a fist fight I could of probably let it slide with a long suspension but to pull a weapon was the wrong thing to do and then I ask him why didn't he just fire the guy and get it over with rather then letting it esculate. The good news is that my ex-assistant got hired on right down the road at the next course so he at least will not be in bad shape for christmas.

    The one fact that I kept out of all of these post is that my ex-assistant is my nephew. I never treated him like family at work and my family is not as close as most peoples are. There is always that person that thinks I show him favoritism at work but I do not show him any more then the next worker. This is my liveyhood and in my mind that comes first. finding another assistant as good as him will be difficult he would work every weekend and never missed sick time.
