ESA Compliance

Pesticides and the Endangered Species Act

The Endangered Species Act (ESA) requires federal agencies, like the EPA, to consult with the relevant wildlife agencies (FWS and NOAA Fisheries) to ensure their actions do not jeopardize the continued existence of a species or destroy its critical habitat. The EPA’s pesticide programs can affect endangered species, requiring consultation to address these impacts. The EPA continues to move forward with a multi-chemical, multi-species strategy outlined in its 2022 ESA Workplan. The agency believes this approach is more efficient than its former chemical-by-chemical review process and will help reduce litigation and speed up consultations. All of this work will impact future use of pesticides by the golf industry.
